THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN CONTEMPT CASE NO.1711 OF 2013 ORDER:
This Contempt Case is filed alleging violation of the orders passed by this Court in W.P. No.33878 of 2011 dated 06.01.2012. The said order, violation of which is alleged, only required the Station House Officer to file a counter-affidavit before 19.01.2012, failing which to be present in the Court along with the records. It is not in dispute that a counter-affidavit was filed by 19.01.2012 and the Station House Officer was also present. The contempt jurisdiction of this Court is invoked on the ground that the undertaking given in the counter-affidavit has not been complied with. These are matters which are required to be examined in the Writ Petition filed by the petitioner herein, or in the miscellaneous petitions, if any, filed therein. That does not however justify the contempt jurisdiction of this Court being invoked.
As the order of this Court, in W.P. No.33878 of 2011 dated 06.01.2012, has not been violated, much less wilfully and deliberately, I see no reason to proceed against the respondent under the Contempt of Courts Act. The Contempt Case is, accordingly, closed. The miscellaneous petitions pending, if any, shall also stand closed. No costs.
