ORDER

This writ petition is filed challenging the notice dated 30.03.2019 issued under Sections 452(1) and 461(1) of the Greater Hyderabad Municipal Corporation Act, 1955, by the 3rd respondent, alleging that the petitioner had encroached upon the road widening portion as against the sanctioned plan. By the said notice, the petitioner was directed to stop the work forthwith and submit her explanation within three days from the date of its receipt. 2.

Heard learned counsel for the petitioner and leaned Standing Counsel for respondents 2 to 4.

Having regard to the facts and circumstances, since the petitioner was given only three days' time to submit her explanation and as, admittedly, she has not submitted her explanation in the said period, it would be appropriate, if 10 days time is granted to her to submit the explanation to the impugned notice. 4.

Accordingly, the Writ Petition is disposed of, giving liberty to the petitioner to submit her explanation to the impugned notice dated 30.03.2019, within 10 days from today, as the time stipulated in the impugned notice is too short, and on filing such explanation, the respondents shall consider the same and pass appropriate orders in accordance with law. Till such time, no coercive steps shall be taken against the property of the petitioner. No order as to costs.

Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
