HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No.5794 OF 2018 ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking the following relief: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of respondents in not paying salaries to the staff, Building rents, Electricity, Water bills and contingency to the staff of the Urban Health Center which is running by the petitioner society is highly illegal, arbitrary, against all cannons of fair play and contrary to the spirit of the Urban Slum Project and offends Article 14, 15, 16 and 21 of the Constitution of India and Consequently direct the respondents to pay Staff salaries, house rents, water, current and contingencies bills of the Urban Health Center running by petitioner society and to pass such other order or orders as this Hon'ble court may deems fit and proper in the circumstance of the case."

Heard Sri G.Nathesh Reddy, learned counsel appearing for the petitioner, learned Government Pleader for Medical, Health & Family Welfare appearing for respondents 1, 3 & 4 and learned Government Pleader for Revenue appearing for the 2nd respondent. 3.

The case of the petitioner is that the petitioner is a Volunteer Service Society and it is selected as an allotted Urban Health Centre under the Urban (slum) Health Care Project for providing primary health and extension services to the Urban slum in the municipality areas in Gadwal Municipality, Mahabubnagar District, vide Proceedings Rc.No.A8/FW/954/2008, dated 05.02.2009. While so, the 3rd respondent issued proceedings Rc.No.1316/NHM/2015-16, dated 24.05.2016, as per G.O.Ms.No.7, upgrading the Urban Health Centre to Urban Primary Health Centre by removing the NGO. The petitioner society filed W.P.No.24178 of 2016 before this Court and

TA, J W.P.No.5794 of 2018 this Court granted interim suspension of the proceedings in Rc.No.1316/NHM/2015-16, dated 24.05.2016, vide order, dated 26.07.2016, in W.P.M.P.No.29788 of 2016. In spite of the interim order granted in favour of the petitioner society, the respondents are not releasing the amount for staff salaries, house rents, water, current, contingencies bill, etc. The petitioner made representations, dated 30.06.2017 & 18.12.2017, but in vain. Aggrieved by the same, the present writ petition is filed.

Without going into the merits of the case, it would be suffice to dispose of the writ petition directing the respondents to consider the representations of the petitioner, dated 30.06.2017 & 18.12.2017, if not already considered, and pass appropriate orders, as expeditiously as possible, preferably within a period of six (06) weeks from the date of receipt of a copy of this order, in the light of their guidelines or any law applicable to the facts of the case.

With the above observations, the Writ Petition is disposed of. There shall be no order as to costs.
