THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION NO.2868 OF 2006 ORDER:

This writ petition is filed aggrieved by the orders in case No.D1/6001/2005, dated 12-01-2006 passed by the third respondent. The petitioners filed a revision petition on 20-12-2005 under Section 9 of Record of Rights Act before the District Collector, Ranga Reddy District and the said revision petition was rejected, advising the petitioner to approach the competent Civil Court for redressal.

As seen from the Memo dated 12-01-2006, it shows that no opportunity of hearing was given to the petitioners, except making an observation that since the matter is sub judice and as the suit in O.S.No.942 of 2003 on the file of the I-Additional Senior Civil Judge, Ranga Reddy District is pending, the revision was closed. 4.

Having regard to the facts and circumstances of the case, since the revision was closed without hearing the petitioners, the writ petition is disposed of directing the petitioners to revive the revision petition before the respondents, if so advised and if the same is filed, the respondents shall consider the same and pass appropriate orders after giving reasonable opportunity to the petitioners, within a period of three months. No order as to costs.

As a sequel, the miscellaneous petitions, pending if any, shall stand closed.
