THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO CONTEMPT CASE No.1113 OF 2017 O R D E R :

This Contempt Case is filed alleging willful disobedience of the order dt.07.12.2016 in WP.No.32112 of 2016.

In the said order, this Court allowed the Writ Petition setting aside the impugned order dt.09.06.2016 passed by respondents 2 and 3 therein and directed them to issue show cause notice to petitioner, why she shall not be reverted from the post of Professional Assistant to her earlier post of Library Attendant, permitted the petitioner to submit explanation to the show cause notice, and then directed respondents 2 and 3 therein to pass a reasoned order.

It is not disputed by the petitioner that these directions in the order dt.07.12.2016 were fully complied by the respondents. 4.

However, petitioner's grievance is that she was not paid salary in the post of Professional Assistant where she worked before her actual reversion pursuant to the further enquiry conducted pursuant to the order dt.07.12.2016 in W.P.No.32112 of 2016. 5.

In my opinion, this grievance of the petitioner is a separate and distinct cause of action and cannot be said to be arising out of the order dt.07.12.2016 in W.P.No.32112 of 2016 for which she can maintain this contempt case.

Therefore, this Contempt Case is dismissed with liberty to the petitioner to agitate about the said grievance in an appropriate and separate proceeding. No costs.

Consequently, Miscellaneous Petitions pending if any, shall stand closed.
