SMT. JUSTICE T.RAJANI CRIMINAL PETITION No.2151 of 2018 ORDER:

This Criminal Petition is filed under Sections 439(1)(b) and 440(2) of Cr.P.C., for modification of the condition imposed by the XIII Additional District and Sessions Judge (F.T.C.) Vijayawada, in Crl.M.P.No.2159 of 2017 in Cr.No.210 of 2017. 2.

The condition being that, one surety shall be from the respective native places of petitioners and the other shall be local surety, the counsel for petitioners seeks modification of the said condition.

The Public Prosecutor opposed the modification on the ground, that the petitioners hail from West Bengal. 4.

In the light of the above, this Court is of the view that the modification cannot be permitted.

Hence, the Criminal Petition is dismissed. Miscellaneous applications, if any pending in this criminal petition, shall stand dismissed.
