THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.2100 OF 2018 ORDER:

This petition is filed by the petitioner-accused under Section 482 Cr.P.C. to quash the proceedings in Cr.No.43 of 2018 on the file of the Station House Officer, II Town Police Station, Karimnagar, which was registered for the offence punishable under Section 3 (1) (r) (s) of SCs & STs (POA) Amendment Act,2015.

Heard learned counsel for the petitioner, learned Assistant Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioner would submit that the petitioner is claiming title and ownership over the disputed property. The revenue records are manipulated. Further, there is an order passed by this Court, dated 11-08-2014 in ASMP No.1311 of 2014 in ASMP No.526 of 2014 in A.S.No.120 of 2014, wherein this petitioner is permitted to receive the rents from the lessees in respect of the sheds existing in the suit property. He also contended that the subject property belongs to this petitioner and a false report is made. Further, Udaya Bhaskar Reddy has nothing to do with the subject sheds.

As all the allegations and contentions require examination, it is not appropriate to quash the proceedings. In view of nature of allegations, the Station House Officer/Investigating Officer is directed to complete the investigation and file final report, without arresting the petitioner-accused in the above crime.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
