HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.5768 of 2018 ORDER:

When the matter is taken up for hearing, learned Standing counsel appearing for the respondents submits that the petitioner is challenging the sale notice dated 06.02.2018 and the respondents could not conduct sale on that day and, therefore, the cause in the writ petition does not survive for adjudication. Today, despite the matter being listed under the caption " FOR DISMISSAL" , when the matter is taken up for hearing, none appears for the petitioner and there is no representation on his behalf.

In view of the submission made by the learned Standing Counsel appearing for the respondents, this Court is of the considered view that the cause in the writ petition does not survive for adjudication and has become infructuous.

Accordingly, the writ petition is dismissed as infructuous. No order as to costs.
