Heard the learned counsel for the petitioners and the learned Government Pleader for the respondents.
The case of the petitioners is that they are the owners of the lands to an extent of Ac.0.06 guntas each in survey Nos.100/E1, 100/E2/1, 100/E3, 100/E, situated at Kalvapalli Village, Rainigudem Post, Garidepalli Mandal, Suryapet (Nalgonda District), and that they have been cultivating the same since more than 50 years. The petitioners have approached this Court complaining the inaction of the official respondents in not conducting the survey and identifying the lands mentioned above. Even though they have filed an application before the concerned authorities on 15.11.2018 and paid necessary fee through challan for conducting the survey and demarcating the lands, the official respondents have not yet conducted survey and as such left with no other option, they filed the present writ petition. The learned Government Pleader appearing on behalf of the respondents has fairly stated that the sub-division has to be done by the concerned authorities and they will do the same in accordance with law, provided the petitioners make a fresh application before the concerned authority.
In view of the above submission, the Writ Petition is disposed of directing the petitioners to make a fresh application seeking sub-division of the lands held by them within a period of two weeks from the date of receipt of a copy of this order and on such
WP No.7159 of 2020 AAR,J application being made, the official respondents shall conduct the survey and demarcate the land duly sub-dividing the land belonging to the petitioners, within a period of eight weeks thereafter, after putting the petitioners as well as other interested persons on notice and strictly in accordance with law. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. ________________________ A.ABHISHEK REDDY, J Date : 27.05.2020.
