This Writ Petition is filed for a Mandamus to declare the action of respondent No.2 in not granting building permission to the petitionerCompany in respect of the land admeasuring Acs.2-00 guntas in Survey No.36 Part, situated at Gachibowli, Serlingampally, Hyderabad, as per its application, dated 16-03-2013, as illegal and arbitrary.

At the hearing Mr.Sampath Prabhakar Reddy, learned Standing Counsel for Greater Hyderabad Municipal Corporation, placed before this Court Letter No.22418/16/03/2013/HO/2771, dated 14/1708-2013, of respondent No.3, whereby he has refused the application for building permission filed by the petitioner and returned the plans unapproved.

Mrs.Rachna S. Waddepalli, learned Counsel for the petitioner, submitted that she is not aware whether her client has received the abovementioned rejection order at any point of time. The learned Standing Counsel has, however, submitted that the rejection order was dispatched on 17.08.2013 itself to the petitioner.

Irrespective of whether the rejection order was received by the petitioner or not, the fact appears to remain that the petitioner's application for building permission was refused by respondent No.3 as far back as 14/17-8-2013. If the petitioner feels aggrieved by such refusal, it is entitled to avail a fresh remedy.

The Writ Petition is, accordingly, disposed of as infructuous with liberty to the petitioner to avail appropriate remedy, if it feels aggrieved by the rejection of its application for building permission. As a sequel to disposal of the Writ Petition, WPMP.No.55068 of 2015, filed by the petitioner for interim relief, is disposed of as infructuous. ______________________ (C.V.Nagarjuna Reddy, J) Dt: 6th January, 2016 lur
