HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.832 OF 2011

O R D E R

This writ petition is filed for a writ of mandamus declaring the action of the 2nd respondent in issuing the impugned proceedings dated 07.12.2010 cancelling the permission to the petitioner for hoardings situated at H.No.5-4203, Takia Amanullah Shah Wakf, Boats Club, Secunderabad, as illegal and arbitrary and for a consequential direction to set aside the same. While admitting the writ petition on 24.01.2011, this Court passed the following interim order.

"It is not in dispute that the 1st respondent granted licenses to the petitioner, which are valid upto 31.03.2011. Assuming that the Wakf Board has revoked its NOC, the 1st respondent cannot require the petitioner to remove the hoardings. Further, it is brought to the notice of this Court that the petitioner had cleared the arrears of fees to the Wakf Board and the matter for renewal of NOC is under consideration.

Hence, there shall be interim stay of further steps in pursuance to the order. It is made clear that the order shall not be treated as permitting the petitioner to retain the hoardings even after expiry of the period of licence, unless it is renewed." Heard the learned counsel for the petitioner and Sri P.Keshava Rao, learned counsel for respondents 1 and 2.

Learned counsel for the petitioner submits that in pursuance of the above interim order, the licence of the petitioner is extended for further period and is in subsistence as on today; that the petitioner has also paid licence fee; and that no further orders are required.

In view of the aforesaid submission, the writ petition is closed. No costs. As a sequel, miscellaneous petitions pending if any, shall stand closed. ____________________________
