HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.26431 of 2017 ORDER:

This Writ Petition is filed questioning the inaction of respondent No.3, in disposing of the proceedings in I.A.No.1 of 2016 in File No.226 of 2016, as being illegal and arbitrary.

Respondent No.4 is alleged to have filed proceedings in File No.226 of 2016 before respondent No.3 to declare that she is entitled to 1/3rd share in the share of petitioner i.e. 1/11th share in Sammakka Saralamma Jathara (Medaram Jathara); and, along with the said proceedings, I.A.No.1 of 2016 was filed seeking not to disburse 1/11th share of the petitioner. Respondent No.3 passed an ex parte interim order directing respondent Nos.3 and 5 not to disburse 1/11th share and directed that the matter be listed on 26.03.2016. The grievance of the petitioner is that on 26.03.2016 he sought time for filing vakalat; and, the matter though underwent many adjournments from time to time i.e. 21.05.2016; 04.06.2016; 18.06.2016; 27.08.2016 and 03.09.016, respondent No.3 has not disposed of proceedings in I.A.No.1 of 2016 in File No.226 of 2016. Hence the writ petition.

Learned Government Pleader for Social Welfare seeks time to get instructions.

The grievance of the petitioner being limited to the extent of non-disposal of File No.226 of 2016 by respondent No.3, there shall be direction to respondent No.3 to pass orders in File No.226 of 2016 within a period of ten days from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of. Consequently, Miscellaneous Petitions pending, if any, shall stand dismissed.
