HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 19111 OF 2002 ORDER: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the petitioner and Sri Venkata Raghu Ramulu, learned Government Pleader for respondent No.1. None appears for respondent No.2 though served.
In the instant writ petition, the petitioner makes the following prayer:
"For the reasons stated above, it is prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or direction, preferably one in the nature of Writ of Mandamus declaring the action of the 1st respondent in not accepting the tax in respect of the Petitioner's Tractor Trailer bearing Registration Nos. AP 22/D3627 and AP22/D3522, covered by valid Permit No.534/A3/Nlg./2002, valid upto 24.5.2005, to enable the petitioner to operate the said vehicle under the said permit, as illegal, arbitrary and unjust and consequently direct the 1st respondent permit the Petitioner to operate the said vehicle under the said permit, by accepting the tax forthwith; and pass such other or further orders as are necessary."
Sri Venkata Raghu Ramulu, on instructions, submits that respondent No.2 has been paying the tax in respect of the Tractor Trailer bearing Registration Nos. AP 22/D3627 and AP22/D3522 covered by valid permit No.534/A3/Nlg./2002.
In view thereof, nothing further survives in the writ petition. Writ Petition is disposed of as infructuous. It is made clear that we have not expressed any opinion in respect of the dispute between
the petitioner and respondent No.2 over the ownership of the vehicles. Miscellaneous petitions, if any, also stand disposed of. No order as to costs.
