THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM Writ Petition No 5806 of 2018 ORDER:

This Writ Petition is filed by the petitioners with an apprehension that the National Highways authorities are in the process of laying third Bypass Road around Narayankhed, which is in between two existing bypass roads, by entering into the petitioners' lands without issuing any notice and without following due process of law.

It is the case of the petitioners that there is a news item published in the newspapers with respect to the proposed Bypass Road being laid. The petitioners apprehend that their lands in Survey Nos.50, 54, 55, 58, 59, 62 and 149 etc situated at Narayankhed Village, Sangareddy District would get affected and in those circumstances, they filed the present writ Petition seeking Writ of Mandamus with a direction to the respondents not to disturb the petitioners' possession without following due process of law.

Heard the learned counsel for the petitioners, the learned Government Pleader for Land Acquisition (TG) and the learned Assistant Solicitor General for the respondents 3 and 4.

Learned Assistant Solicitor General as well as the learned Government Pleader submits that as on date there is

CKR, J W.P.No.5806 of 2018 no proposal to lay any new road as apprehended by the petitioners, however, if the land is required for any public purpose, the respondents would strictly follow the procedure prescribed under law.

Having regard to the respective submissions, this Writ Petition is closed recording the submissions made on behalf of the National Highways Authority of India and the Ministry of Road Transport & Highways. No order as to costs. Miscellaneous Petitions, if any, pending shall stand closed.
