THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.10967 OF 2015 ORDER:
This writ petition is filed challenging the interference of the respondents 2 and 3 in civil disputes in respect of the land to an extent of Acs.2.19 guntas situated in survey No.387/D of Akkannapet Village, Husnabad Mandal, Karimnagar District.
The petitioners state that the land to an extent of Acs.4.00 guntas was mutated in the names of the petitioners and they are jointly cultivating the said land. While so, the respondents 4 to 6, who are no way concerned with the said survey No.387/D, are trying to grab the land of the petitioners with the help of unsocial elements. In those circumstances, they filed O.S.No.79 of 2014 seeking perpetual injunction before the learned Junior Civil Judge, Husnabad, and an order of temporary injunction was granted in I.A.No.333 of 2014 on 12.08.2014. In spite of the same, when the respondents 2 and 3 are trying to interfere at the instance of the respondents 4 to 6, present writ petition is filed.
Since it is a case of highhandedness of the respondents 2 and 3, it is open to the petitioners to bring it to the notice of the higher authorities, if there is any misuse of power. In the circumstances, this writ petition is disposed of giving liberty to the petitioners to bring it to the notice of the Superintendent of Police or to the District Collector, or any Government authority with regard to misuse of power by the respondents 2 and 3 and it is needless to observe that the higher authority shall consider the same in accordance with law. The writ petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. __________________________ A.RAMALINGESWARA RAO, J 27.03.
