HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6666 of 2015 ORDER:
The petitioner filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail.
It is the case of the petitioner that his wife demanded him not to look after his old aged parents, for which, he refused and then, she went to her parents' house by threatening that she would lodge a complaint against him. The petitioner came to know that his wife lodged a complaint before Kukatpally Police Station. The learned Public Prosecutor informed that no case is registered as alleged by the petitioner herein. Learned Counsel for the petitioner submitted that the SubInspector of Police called the petitioner over phone and directed him to return the jewellery belonged to the wife of the petitioner herein and further, the Sub-Inspector also stated that in case of failure on the part of the petitioner, a case will be registered. Apprehending arrest, the petitioner filed this petition.
Considering the facts and circumstances of the case, this Court is inclined to dispose of this petition with the following direction: "If any complaint is lodged by the wife of the petitioner viz., M. Pallavi, the same shall be informed to the petitioner herein. The S.H.O., concerned is also directed to take action on the complaint, if any lodged by the wife of the petitioner, by following the procedure under the amended provisions of Section 41 Cr.P.C." _________________ Justice Raja Elango 14.7.2015 Nn.
