In this Writ Petition, the petitioner seeks release of stocks seized from the petitioner shop pursuant to a Mediators Report dt. 28.10.2015 pending proceedings under Section 6-A of the Essential Commodities Act, 1955 (for short 'the Act) before the 2nd respondent.
Learned counsel for the petitioner states that the petitioner is willing to furnish bank guarantee for the value of the stocks seized from the petitioner shop. Learned Government Pleader appearing for the respondents states that subject to the petitioner furnishing bank guarantee for the market value of the stocks seized, and keeping the bank guarantee alive during pendency of Section 6-A proceedings before the 2nd respondent, the stocks may be directed to be released.
Having regard to the said submission, the Writ Petition is disposed of directing the 2nd respondent to release the seized stocks from the petitioner shop pursuant to the Mediators Report dt. 28.10.2015 pending proceedings under Section 6A of the Act, subject to the petitioner furnishing the bank guarantee for the value of the seized stock as assessed by the 2nd respondent and subject to the petitioner keeping the said bank guarantee alive during pendency of Section 6A enquiry. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
