HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.10542 of 2016 ORDER :

This Criminal Petition is filed under Section 482 of Cr.P.C. by the petitioner/accused seeking to quash the order dated 04.07.2016, passed in Crl.R.P.No.27 of 2016 on the file of VIIAdditional District and Sessions Judge, Ongole. Heard learned counsel for petitioner and the learned Public Prosecutor and perused the material available on record. Accused sought summoning of one Jarubula Ankamma Chowdary for examining as a witness in a case relating to Section 138 of Negotiable Instruments Act. Having heard learned counsel for petitioner and the material on record, I do not find any ground to interfere with the impugned order rejecting the request of petitioner. The evidence of said witness is neither relevant nor necessary in the present case registered under Section 138 of Negotiable Instruments Act. Hence, I am of the view that both the Courts below have rightly rejected the request of petitioner for summoning the witness. Accordingly, the Criminal Petition is dismissed. Consequently, pending miscellaneous applications, if any, shall stand closed.
