THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM Writ Petition No 5801 of 2018 ORDER:

This Writ Petition is filed challenging the action of the official respondents proposing to take the petitioners' lands in Survey Nos.18/ 19, 18/ 22 and 18/ 31 to an extent of Ac.0.91 cents respectively situated in Ramachandrapuram village, Ranasthalam Mandal, Srikakulam District, for the purpose of Kovvada Nuclear Power plant without considering the petitioners' objections, and consequently direct the official respondents to consider the petitioners' objections and pay compensation in respect of the lands under acquisition. 2.

The case of the petitioners is that the petitioners are the bonafide owners of dry lands situated in Ramachandrapuram Village, Ranasthalam Mandal, Srikakulam Mandal to an extent of Ac.0.40 cents in Survey No.18-1, to an extent of Ac.0.42 cents in Survey No.18-3, to an extent of Ac.0.61 cents in Survey No.18-31 having purchased the said lands by their father late Mylapalli Ramulu. After the demise of the petitioners' father, they became the absolute owners of the said lands. The Government of India proposed to build the Nuclear Power Plant at Kovvada, Ranasthalam Mandal, Srikakulam District and accordingly, the State Government issued a notification for acquisition of lands including the

CKR, J W.P.No.5801 of 2018 lands of the petitioners situated at Ramachandrapuram Village, Kovvada, Ranasthalam Mandal, Srikakulam District. Pursuant to the said notification, the petitioners filed their objections on 16.05.2017. This Writ Petition is filed seeking a direction to the official respondents to consider the petitioners' objections, as they apprehend that the objections would not be considered and in the process the compensation amount would be paid to the unofficial respondents. 3.

Heard the learned counsel for the petitioners and the learned Government Pleader for Land Acquisition (A.P.) appearing for the respondents 1 to 5.

Having considered the respective submissions and taking into consideration the grievance of the petitioners, this Writ Petition is disposed of directing respondent No.4 to consider the objections, filed by the petitioners, and pass appropriate orders determining the entitlement of compensation in accordance with law. No order as to costs.

Miscellaneous Petitions, if any, pending shall stand closed.
