HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.42069 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking declare the action of the VI Additional Judicial Magistrate of First Class, Warangal, in entertaining the complaint lodged by the 2nd respondent for the offence under Section 138 of the Negotiable Instruments Act.

It is the case of the petitioner that the learned Magistrate has no territorial jurisdiction to entertain the complaint lodged by the 2nd respondent.

The petitioner is alleged to have committed the offence under Section 138 of the Negotiable Instruments Act. In view of the fact that the dispute is in between two individuals, this petition is not maintainable. 4.

Accordingly, the Writ Petition is dismissed. No costs. However, the petitioner is at liberty to approach the appropriate forum for the relief of transfer of the case. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
