THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.945 of 2016 ORDER:

The grievance of the petitioner in this case is as under: "The Hon'ble Court may be pleased to issue any Writ, order or direction more especially one in the nature of Writ of Mandamus declaring the action of Respondents 3 & 4 in interfering with the petitioner's lawful construction of Building by regularly calling the petitioner to the police station for forcible settlement with the 3rd parties by interfering with the civil disputes is illegal, arbitrary and unconstitutional and consequently direct the respondents 2 to 4 not to interfere with the Petitioner's Lawful Construction of Building at Sy.No.454/EE Admeasuring 1130 Sq.Yards, situated at Thippannapet Shivar Village, Jagtial Mandal, Karimnagar District by calling the petitioner insisting to settle the civil disputes in the 4th respondent police station with 3rd parties and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case."

The Inspector of Police, Jagtial Town Police Station, filed a counter-affidavit stating that no case had been registered against the petitioner on the file of the Jagtial Town Police Station and that he was neither a suspect nor was he required in relation to any pending crimes on the file of the police station. He further stated that the petitioner's residence was not even situated within the limits of the said police station and therefore, the question of interfering with his construction activity did not arise. The Inspector denied the allegation of the petitioner as to forcing him to enter into any settlement with third parties. He asserted that the allegation of the petitioner that the police authorities were forcing him to settle civil disputes and asking him to come to the police station for the purpose of signing papers and parting with money was absolutely false.

In view of the afore-stated unrebutted counter-affidavit averments, which are duly taken on record, this Court finds no reason to entertain this writ petition for adjudication on merits.

Sri C. Hari Preeth, learned counsel for the petitioner, is also agreeable to the closure of the writ petition recording the stand of the police authorities.

The writ petition is accordingly closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
