THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.2110 OF 2018 ORDER:

This petition is filed by the petitioners-A1 to A3 under Section 482 Cr.P.C. to quash the docket order, dated 09-06-2017 in Crl.M.P.No.1802 of 2016 in C.C.No.108 of 2016 on the file of the Principal Junior Civil Judge-cumJudl. I Class Magistrate, Gudivada, Krishna District, wherein Section 452 IPC was added in C.C.No.108 of 2016. 2.

The learned Magistrate while dealing with the subject matter, held that there is a prima facie case against the petitioners-A1 to A3 that the petitioners have trespassed after preparing for causing hurt and basing on the material placed on record, cognizance was taken for the offence punishable under Section 452 IPC.

There are specific allegations with regard to constitution of an offence under Section 452 IPC. No infirmity is found in the order of the Court below passed in the Crl.M.P.No.1802 of 2016 in C.C.No.108 of2016, dated 09.06.2017. Therefore, the petition is devoid of merit and is liable to be dismissed.

Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
