HON'BLE SRI JUSTICE S.V. BHATT W.P. No.11653 OF 2017 ORDER:

Mr.K.Venkatesh appearing for petitioners having regard to the writ prayer and the objections raised in the counter affidavit, requests the Court to permit the petitioners to avail the remedy of filing suit before Court of competent jurisdiction, and consider extending the status quo order for reasonable period. Mr.Ravi Cheemalapati does not express objection to the first limb of the submission, but for extending the status quo submits that the order dated 03.04.2017, if extended, will be misunderstood as this Court facilitating the civil Court to grant interim order and further in the pending contempt case, the respondents will have difficulty in answering the Court.

Mr.K.Venkatesh by way of reply submits that with the disposal of the writ petition, the contempt case complaining disobedience of the interim order merges with the final order and appropriate statement would be made in this behalf before hearing the contempt case.

After taking note of limited submissions, the writ petition is disposed of by this order:

(a) petitioners are given liberty to avail the remedy of suit in accordance with law before the Court of competent jurisdiction (b) the status quo as on date shall be maintained for a period of two weeks from today.

Either the grant or consideration of status quo for a period of two weeks shall not be understood as this Court is considering the case of petitioners on merits and thereafter on being satisfied with the prima facie case extended the status quo order for two weeks. At the same time, the petitioners if seek remedy before the competent Court, the remedy shall be examined on its own merits and orders passed. No order as to costs.
