THE HONOURABLE SRI JUSTICE DILIP B.BHOSALE CIVIL REVISION PETITION No.321 OF 2015 ORDER:

This Civil Revision Petition is filed by the petitioner seeking direction to the Court below to decide E.A.No.775 of 2014 in E.P.No.476 of 2014 in O.S.No.663 of 2013 expeditiously. I am not inclined to issue any such direction and I am satisfied that the following order shall meet the ends of justice:

1) It is open to the petitioner to move the learned Judge where the aforementioned application in Execution Petition is pending for its expeditious hearing by making written application to that effect;

2) If any such application is made, the learned Judge shall consider the same and endeavor to fix hearing of E.A.No.775 of 2014 and decide the same expeditiously;

3) It is needless to mention that while deciding E.A.No.775 of 2014 the learned Judge shall grant an opportunity to the respondents of being heard and decide the application on merits in accordance with law; and

4) It is also needless to mention that the learned Judge may also consider pending Execution Application, if any, along with E.A.No.775/2014 either by common order or by separate orders as the case may be.

With these observations, the Civil Revision Petition is disposed of. No costs.

Miscellaneous petitions pending in the Civil Revision Petition, if any, also stand disposed of.
