This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner in Crime No.191 of 2026 of KPHB Colony Police Station, Cyberabad District, registered for the offences punishable under Sections 85 of the BNS, Sections 3 and 4 of Dowry Prohibition Act and Section 3(1)(r)(s) of SCs/STs (POA) Act.

The case of the prosecution is that the de facto complainant lodged a complaint before police on 05.02.2026, wherein it is stated that she got married in the year 2013 and after few years she left and has been living separately due to disputes. It is stated that since 2022, she has been working as staff nurse at Rainbow Hospital in Hydernagar and residing in KPHB Colony. In the year December, 2023, she met a person by name Rajkumar through online and got acquaintance with him. After he expressed towards a proposal to marry her, she informed about her past marriage. Even then he accepted to marry her and thereafter their marriage was performed on 01.05.2025 in the temple and it was registered in the SubRegistrar office. For about seven months they lived happily.

Thereafter disputes arose between them and the complainant went to her native village. Thereafter, petitioner's mother, father and brother called her and abused her in the name of her caste and also insulted her by calling as 'widow'. It is further stated that the petitioner left from the house without informing anyone, for which he approached the police and they sent notice to him.

Learned counsel for the petitioner would submit that the petitioner is innocent of the offences alleged against him; that there are no specific allegations against the petitioner; that the petitioner is working as Police Constable in Khila Warangal, Warangal District; that the petitioner never resided with the complainant and that only to harass the petitioner she falsely implicated the petitioner in this crime and the petitioner is ready to cooperate with the Investigating Authority and hence, he prays to grant Anticipatory bail to the petitioner. 5.

On the other hand, learned Additional Public Prosecutor opposed the same and contended that the offences alleged against the petitioner are severe in nature. The allegation levelled against the petitioner is that when the complainant enquire about whereabouts of A.1, A.2 and A.3, the petitioner scolded in the name of her caste over phone and hence, he prays to dismiss the petition.

Having regard to the submissions made by both the parties and considering the material on record, it is noted that the complainant married the petitioner in the year 2015. There

is allegation against the petitioner that he never demanded any dowry from the complainant. Considering the allegations made against the petitioner and that the petitioner, this Court is inclined to grant Anticipatory bail to the petitioner subject to the following conditions:

(i) The petitioner shall surrender before the Station House Officer, KPHB Colony Police Station, Cyberabad, within two (2) weeks from today, and on such surrender, the petitioner shall be released on bail on executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each.

(ii) The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

(iii) The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required. 7.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
