HON'BLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No. 7239 of 2019 ORDER:
1) The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not granting the electricity connection to the premises Door No.8-2-120/ 120/ 1 situated at Sy.No.129/ 108 Old Sy.No.403/ 42 of Shaikpet, present Nandi Nagar, Road No.14, known as Noor Nagar, side of Road No.10, Banjara Hills, Hyderabad, as illegal, arbitrary and violation of principles of natural justice.
2) Heard Sri Venkata Raghu Mannepalli, learned counsel for the petitioner and Sri R.Vinod Reddy, learned Standing Counsel appearing for respondents 2 to 5.
3) The only grievance of the petitioner is that though he made an application seeking New Connection on 23.08.2018, till date the respondents are not granting electricity connection to the building constructed by him.
4) Sri R.Vinod Reddy, learned Standing Counsel appearing for respondents 2 to 5 would submit that the very construction of the building is un-authorised and in the earlier round of litigation, the petitioner sought a direction from this Court
against the G.H.M.C. for regularization. Accordingly, an application is being made and the same is pending before the G.H.M.C. Unless the G.H.M.C. regularized the construction, the respondents 2 to 5 cannot take up the matter.
5) Without going into the merits of the case, the Writ Petition is disposed of, giving liberty to the petitioner to file all the required application, documents and permissions before the respondents including the regularization proceedings obtained from the G.H.M.C., in which event, respondents 2 to 5 shall expedite the same in accordance with law.
6) Consequently, miscellaneous petitions if any pending in this writ petition shall stand closed. No order as to costs. __________________ T. AMARNATH GOUD, J 26.04.2019 gkv
