Ch.Raveendra v. Gara Aswatha Narayana And Another
THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CIVIL REVISION PETITION No.1449 of 2018 ORDER:
Heard learned counsel for the petitioner. The petitioner is judgment debtor in E.P.No.24 of 2013 in O.S.No.411 of 2011 on the file of Principal Senior Civil Judge, Nellore. In the said Execution Petition, the 1st respondent/decree holder filed E.A.No.187 of 2017 to call for salary particulars of garnishee of judgment debtor, the 2nd respondent herein, and as to why action shall not be initiated against him in failing to recover salaries from salaries of the judgment debtor and recovering the amounts contrary to salary attachment warrant effected on him. When the Executing Court issued a notice in the said application, the present Civil Revision Petition is filed.
2.
It is evident from the above prayer that the application is directed against the 2nd respondent garnishee, but not against the petitioner. It is not known as to what defence the 2nd respondent is going to take in the application and what order the lower Court is going to pass. The present Civil Revision Petition filed by the petitioner is not maintainable and it is premature. 3.
Accordingly, the Civil Revision Petition is dismissed. Miscellaneous petitions, if any, pending in this civil revision petition shall stand closed. There shall be no order as to costs. ________________________________ A.RAMALINGESWARA RAO, J MARCH 19, 2018 YVL
