SMT JUSTICE T.RAJANI CRIMINAL PETITION No.2117 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of bail to the petitioners, who are accused Nos.1, 6, 8 and 12, in Crime No.130 of 2017 on the file of the Station House Officer, Chirala Rural Police Station, Prakasam District. The offences alleged are under Sections 302, 307, 144, 148, 324, 354, 452 and 509 R/w.149 I.P.C. and Sections 3(1)(w)(i), 3(2)(v), 3(2)(va) and 3(1)(r)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015.

Heard the learned counsel for the petitioners, learned Public Prosecutor appearing for the respondent-State, and perused the record. 3.

As per the case of the prosecution, accused No.1 beat the deceased on her head with iron rod, accused Nos.6 and 8 held the hands and legs of the deceased, and accused No.12 threatened the deceased with weapons. 4.

Hence, from the above, it can be inferred that the petitioners/accused Nos.1, 6, 8 and 12 participated in the crime and there are specific overt acts against each of the accused.

Learned counsel for the petitioners submits that accused No.2 was already enlarged on bail. But, learned counsel fairly admits that it was on the ground of health condition of accused No.2, which is not available to the petitioners.

Hence, considering the above, this Court is not inclined to grant bail to the petitioners. Accordingly, the Criminal Petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
