HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.10904 OF 2001 ORDER:

This writ petition is filed seeking to issue a writ of Mandamus declaring the action of the 4th respondent-college in not forwarding the proposals of the petitioner under Career Advancement Scheme for Selection Grade and Reader's Designation to respondents Nos.1 to 3 herein as arbitrary and illegal, and consequently, to direct the 4th respondent-college to forward the proposals of the petitioner to respondents Nos.1 to 3 for considering her case for Selection Grade and Reader's Designation under Career Advancement Scheme.

Heard Sri M.V. Durga Prasad, learned Counsel for the petitioner and the learned Government Pleader for Higher Education.

It has been contended by the learned Counsel for the petitioner that the petitioner is working as a lecturer in Economics in the 4th respondent-college since 1982 and the post held by the petitioner was admitted into grant-in-aid, and as per UGC guidelines as well as the rules issued by the State Government, the petitioner is entitled to be considered for Selection Grade and Reader's Designation under Career Advancement Scheme, but the
4th respondent is not forwarding the proposals of the petitioner for Selection Grade and Reader's Designation under the Career Advancement scheme, to respondents Nos.1 to 3 for consideration. 4.
The learned Government Pleader for Higher Education contends that no applications/proposals have been received from the 4th respondent for consideration of the case of the petitioner for Selection Grade and Reader's Designation under Career Advancement Scheme, and if the proposals are submitted by the 4th respondent, then respondents Nos.1 to 3 will consider the case of the petitioner and pass appropriate orders.

Having considered the submissions made by both the parties, this Court is of the view that this writ petition can be disposed of with a direction to the 4th respondent to send the proposals of the petitioner, if she is eligible and qualified to be considered for selection Grade and Reader's Designation under Career Advancement Scheme, to respondents Nos.1 to 3. 6.
Accordingly, the Writ Petition is disposed of directing the 4th respondent to submit the proposals for consideration of the case of the petitioner for Selection Grade and Reader's Designation under the Career Advancement Scheme to respondents Nos.1 to 3, within a period of two (2) weeks from the date of receipt of a copy of this order, if she is eligible and qualified to be considered for selection
Grade and Reader's Designation. On such proposals being received from the 4th respondent, respondents Nos.1 to 3 shall consider and pass appropriate orders within a period of four weeks thereafter. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
