O R D E R

This petition is filed under Section 482 of Cr.P.C. seeking to quash the Crime No.44 of 2011 on the file of Gooty Police Station, Ananthapur District, registered against the petitioner for the offence under Section 3(1)(x) and (v) of Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989.

The learned counsel for the petitioner submitted that the de facto complainant / 2nd respondent herein belong to Budaga Jangam community and that he does not belong to Scheduled Caste. When the matter is taken up, the learned Additional Public Prosecutor by producing copy of letter addressed by Sub Divisional Police Officer, Tadipatri to the Superintendent of Police, Anantapur submitted that the police have referred the case as 'mistake of law'. Taking note the above submission of the learned Additional Public Prosecutor, the criminal petition is dismissed as infructuous.
