THE HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION NO.2528 OF 2011 O R D E R :

This petition is filed under Section 482 of Cr.P.C., by the petitioner-J.Narasamma, seeking to quash the proceedings in CC No. 1248 of 2010, on the file of the XV Additional Chief Metropolitan Magistrate, Hyderabad.

In FIR No. 186/2007, the Police of W.P.S. Begumpet laid charge sheet against A1 to A4 for the offences under Section 498 (A), IPC and Sections 3 & 4 of Dowry Prohibition Act. A1 is husband of the de facto complainant, A3 and A4 are the parents of A1, and A2 is the paternal uncle of A1.

A perusal of the complaint, 161 Cr.P.C. statements and charge sheet would show that there are no specific allegations against the petitioner-A4 except some vague, general and omnibous allegations. The only allegation against her is that the petitioner A4, who is the mother-in-law of the complainant used to treat her as maid servant and she used to point out each and every movement of the complainant and harass her. 4.

Except the aforesaid allegation, no specific allegations are made and no overt acts are attributed against the petitioner-A4,

even aforesaid allegations also not in clear terms. Therefore in the opinion of the Court, directing the petitioner - A4 to undergo trial would amount to abuse of process of the Court. 5.

Therefore, the Criminal Petition is allowed.

The proceedings against the petitioner- A4 J.Narasamma in CC No.1248 of 2010 on the file of XV Addl. Chief Metropolitan Magistrate, Hyderabad are quashed.

The Miscellaneous petitions pending, if any, shall stand closed.
