HON'BLE SRI JUSTICE S.V.BHATT C.R.P. No.4597 OF 2017 ORDER:

The timing of application either for reopening the suit or appointing Advocate Commissioner through I.A. No.225 of 2017 is considered and rejected for valid reasons.

This Court is also of the view that suit is for perpetual injunction, parties have completed the evidence and at this stage, reopening or appointing Advocate Commissioner amounts to reopening of aspects in the pending suit. This Court is in agreement with the findings recorded by the trial Court. Revision fails and is dismissed. No order as to costs.
