HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.7012 of 2019 ORDER:
This writ petition is disposed of at the stage of admission with the consent of both the parties.
This writ petition is filed seeking the following relief :- " .....to issue a Writ of Mandamus or any other appropriate Writ Order or direction particularly one in the nature of Writ of Mandamus declaring the in action of the 4th respondent in disposing of the Representation dated 27.12.2018 submitted by the petitioner requesting to regularise the suspension period from 22.12.2017 to 19.04.2018 (119) days and to withdraw the stoppage of (02) increments as illegal, arbitrary and violative principles of natural justice, consequently to direct the 4th respondent to consider the representation dated 27.12.2018 submitted by the petitioner to regularise the suspension period from 22.12.2017 to 19.04.2018 (119) days and to withdraw the stoppage of (02) increments ....." .
Heard Mr.P.Venkanna, learned counsel for petitioner and the learned Government Pleader for Services-II.
It has been contended by the petitioner that he is working as Office Subordinate with the respondents and while discharging his duties, the respondents have placed him under suspension on 22.12.2017 on the alleged ground that some person has given a complaint against the petitioner that he is not properly discharging his duties. Thereafter, the petitioner was reinstated into service on 19.04.2018 by revoking the suspension order and the disciplinary authority imposed punishment of stoppage of two increments without cumulative effect. Thereafter, the petitioner made a representation on 27.12.2018 requesting the respondents to regularize the suspension period in accordance with FR 54-B. But, so
far, the respondents have not passed any orders on the said representation.
Learned counsel for petitioner contended that appropriate orders be passed in the writ petition directing the respondents to regularize the suspension period in terms of FR 54-B. Learned Government Pleader appearing for respondents has contended that the case of the petitioner will be considered and appropriate orders would be passed on the representation submitted by the petitioner in terms of FR 54-B. This Court, having considered the rival submissions, is of the considered view that the writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 27.12.2018 and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.
With the above observations, the writ petition is disposed of. No order as to costs.
