COMMON ORDER:

Heard.

2. With regard to the alleged trespass into the land in survey No.255/7 admeasuring Ac.0-18 cents of Valandapalem, Machilipatnam, Krishna District, the owner filed a complaint, dated 04.02.2015 against third parties. The tenant, who is stated to be occupying the land under the very same order, also filed another complaint on 04.02.2015 making similar allegations. Both these writ petitions are filed alleging that respondent police is not taking any action by registering the crime and not investigating the said case.

3. Learned Government Pleader for Home has obtained instructions from

respondent No.3, wherein it is stated that though the owner and the lessee filed separate identical complaints on 04.02.2015, the complaint of the petitioner/owner in W.P.No.2580 of 2015 is taken up for preliminary enquiry by making an entry in the GD and subsequently, crime No.23 of 2015 was registered on 12.02.2015 against respondent Nos.5 and 6 and is pending investigation.

As is evident from the instructions aforesaid, since a crime is already registered and is pending investigation, these writ petitions are disposed of directing respondent No.3 to complete the investigation expeditiously and thereafter file appropriate final report/charge sheet before the jurisdictional court in accordance with law.

As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
