THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER Writ Appeal No.574 of 2017 JUDGMENT: (per Hon'ble the Acting Chief Justice Sri Ramesh Ranganathan) The premises of the 1st respondent-writ petitioner was locked by the appellants herein pursuant to an order passed by the Competent Authority (4th respondent in the Writ Petition) dated 16.03.2017 affirming the order of the Executive Engineer (Housing), A.P.

Housing Board, Hyderabad. Against the order passed by the Competent Authority, the 1st respondent-writ petitioner preferred C.M.A. No.31 of 2017 before the Chief Judge, City Civil Court, Hyderabad and, by order in I.A.No.1837 of 2017 in C.M.A.No.31 of 2017 dated 30.03.2017, the Learned Chief Judge suspended the order dated 16.03.2017 passed by the Competent Authority for a period of 15 days, and directed the petitioner therein to issue notice to the other side by 06.04.2017.

Sri Kasi Nageswara Rao, Learned Counsel for the 1st respondent-writ petitioner, would submit that the order passed by the Chief Judge, City Civil Court, Hyderabad on 30.03.2017 has been extended subsequently, and the said interim order continues to remain in force as on date. As the order of the Competent Authority dated 16.03.2017 has been suspended, there is no justification for the appellants not to remove the seal over the premises. We

find no error in the order of the Learned Single Judge directing them to do so.

The Writ Appeal fails and is, accordingly, dismissed. The miscellaneous petitions pending, if any, shall also stand dismissed. No costs.
