HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITON No.7009 of 2019 ORDER:

1) This Writ Petition is being disposed of at the admission stage with the consent of both the parties.

2) This Writ Petition is filed for a writ of Mandamus declaring the action of the respondents in not considering the case of the petitioners under 'medically unfit' case to the post of 'Security Guard' or 'RTC Constable' as per circular No.PD17/ 2017, dated 27.07.2017, as arbitrary and illegal and violation of Articles 14 & 16 of Constitution of India and sought consequential direction to direct the respondents to consider the case of the petitioners to the post of Security Guard or RTC Constable as per Circular dated 27.07.2017 by considering the petitioners' representations dated 10.11.2017 and 10.04.2018.

3) Heard Sri K.Venkateswarlu, learned counsel for the petitioners and Sri B.Mayur Reddy, learned Standing Counsel for respondents.

4) It has been contended by the petitioners that the father of the 1st petitioner as well as the father of the 2nd petitioner were employed with the respondent Corporation, who were

declared as medically unfit on 21.03.2017 and 20.02.2018 respectively; and that the fathers of the petitioners have left over service of more than 5 years; and that the petitioners have submitted representations dated 10.11.2017 and 10.04.2018 requesting the respondents to consider their case for appointment as Security Guard or RTC Constable under the Medical Unfit Case, but, so far the respondents have not passed any orders on the said representations.

5) Learned Counsel for the petitioners contends that appropriate orders be passed in the writ petition directing the respondents to consider the representations submitted by the petitioners on 10.11.2017 and 10.04.2018 and pass appropriate orders, in accordance with law.

6) Learned Standing Counsel appearing for the respondents submitted that the case of the petitioners would be considered in accordance with law and appropriate orders would be passed.

7) Having regard to the aforesaid submissions of parties, the writ petition is disposed of directing the respondents to consider the representations submitted by the petitioners on 10.11.2017 and 10.04.2018 respectively and pass orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. No order as to costs. As

a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
