Petitioner And The Northern Power Distribution Company Ltd., rep.by its Managing Director and others. .. Respondents This court made the following :
- 2 - THE HONOURABLE SRI JUSTICE P.NAVEEN RAO WP.No.7015 of 2019 ORDER :
This writ petition is filed alleging illegal disconnection of power supply to petitioner's service connection No.442111005021948 without putting him on notice and affording an opportunity of hearing.
02. Learned Standing Counsel for the respondent-Company placed before this Court, photo copies of two documents. The first document is dated 22-03-2019. At the bottom of said document, it is written "At the time of inspection found that the party was availing supply by directly tapping from near by LT over head line thus he indulged in theft of energy." The second document is notice issued to petitioner informing about disconnection of power supply.
03. According to learned Standing Counsel the power supply is disrupted, since petitioner was found to be indulged in drawing power directly, not through electric meters provided to him and therefore, the same amounts to theft of energy. Copies of this notice are now furnished to learned counsel for the petitioner. Therefore, the respondent-company justified in its action in disconnecting the power supply. If petitioner is aggrieved by the notice issued and allegation made against him of drawing power directly from over head line, it is open for him to work out remedies. But decision of disconnection of power supply cannot be faulted.

04. Leaving it open to work out his remedies on the alleged disconnection of power supply to petitioner, this writ petition is dismissed.
05. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
