HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.3304 of 2015 ORDER:
This revision is preferred challenging the docket order dated 23-11-2015 passed in C.C. No.352 of 2012 by the XV Additional Chief Metropolitan Magistrate, Hyderabad, wherein the learned Magistrate dismissed the application filed by the petitioners under Section 70(2) of Cr.P.C.
The learned counsel for the petitioners submitted before this Court that the petitioners are in abroad and now they intend to come to India and they are ready to face the trial and they will not flee from the hands of justice. It is also informed by the learned counsel that the look out notices are also pending against the petitioners.
Having heard the learned counsel for the petitioners and the learned Additional Public Prosecutor and having perused the material available on record, this Court is of the view that the revision can be disposed of with the following directions: The petitioners-accused Nos.1 and 2 are directed to appear before the Court concerned on or before 10.03.2016 and file a petition to recall the warrant issued against them and on such filing of the petition, the trial Court is directed to recall the warrant on the same day on their execution of bond for a sum of Rs.10,000/- (Rupees ten thousand only) each with one surety for the like sum each. The operation of the look out notices, pending against the petitioners, is also suspended till 15.03.2016. Further, the petitioners are directed to appear before the trial Court regularly. Accordingly, the Criminal Revision Case is disposed of. Consequently, the Miscellaneous Petitions pending, if any, in this revision shall stand closed.
