THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.7108 OF 2019 ORDER:

Heard the learned counsel for the petitioner, learned Government Pleader for respondents 1 and 2 and Sri N.Praveen Kumar, learned Standing counsel for respondents 3 and 4.

The grievance of the petitioner is that the 5th respondent is encroaching on to the public road and making constructions. Though the 3rd and 4th respondents issued notices invoking Section 228(3) & 360 of Telangana Municipality Act, 1965 (for short 'the Act') way back on 20.02.2019, so far no further action has been initiated against the 5th respondent. In those circumstances, petitioner seeks a writ of mandamus declaring the action of the respondents 3 and 4 in not taking any action against the 5th respondent who has encroached upon the public road, as illegal.

Learned Standing counsel on instructions submits that on account of the vacancy of the post of Town Planning Officer, immediate action could not be taken. However, now a new Town Planning Officer has taken charge and necessary action would be taken.

Having regard to the above submission, the respondent authorities are directed to take immediate action on the complaint of the petitioner within a period of

15 days from the date of receipt of copy of this order and communicate the decision to the petitioner.

Accordingly, the Writ Petition is disposed of. No order as to costs.

Miscellaneous petitions pending in the writ petition, if any, shall stand closed.
