HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.8068 OF 2015 ORDER:

Challenging the inaction of the respondents in disposing of the representation dated 07.07.2014 of the petitioner, the present writ petition is filed.

The case of the petitioner is that she is the owner of the property admeasuring Ac.2.20 gts. situated at Chinthaltana Village and the same was acquired by the respondents for the purpose of Mid Manair Project by paying compensation of Rs.5.00 lakhs. While acquiring the said land, the Government has also assured that the alternative sites for the inhabitants of the villagers who were displaced due to submergence of the houses, would be provided. As the petitioner is one of the affected persons due to submerge in the Mid Manair Project, she submitted a representation dated 07.07.2014 to the 2nd respondent-District Collector requesting him to allot one plot at RTC Depot, Vemulawada. But the 2nd respondent did not take any action on the representation of the petitioner so far. Hence, the present writ petition.

Considering the nature of the relief which has been sought in the writ petition, without expressing any opinion, the interest of justice would be served, if a direction is given to the respondents 2, 4 and 5, to consider the representation dated 07.07.2014 of the petitioner, within a period of three months from today in accordance with the existing schemes and subject to eligibility and pass necessary orders. With the above directions, the writ petition is disposed of. Miscellaneous Petitions, if any pending in this writ petition shall stand closed. No order as to costs.
