The case of the petitioners is that General Power of Attorney was executed in favour of the petitioners in respect of the land in Sy.No.446 to an extent of Ac.8-86 cents situated at Anantapur Rural and Mandal, Anantapur District. Thereafter the petitioners approached the 2nd respondent to register the GPA in respect of the above land and deposited an amount of Rs.1,89,650/- towards the Stamp duty and registration charges. The 2nd respondent after receiving GPA, given P.No.12/2016 on 07.01.2016 and kept pending. He neither registered nor refused to register the GPA. Aggrieved by the same, the present writ petition is filed.
Heard both sides.
Since it is stated that GPA document has already been received by the 2nd respondent pending registration vide P.No.12/2016, the 2nd respondent is directed to register the same if the same is in order as per the Stamps and Registration Act and Rules made thereunder. If he wants to refuse the registration, he has to record the reasons as envisaged under Section 71 of the Registration Act and communicate the same to the petitioner.
Accordingly, the writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. ______________________________ A.RAJASHEKER REDDY, J 10.06.2016 dv
