HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITON Nos.7083, 7112 and 7114 of 2019 COMMON ORDER:
1) All these Writ Petitions are being disposed of at the admission stage with the consent of both the parties, by way of common order as the issue raised in these three writ petitions is one and the same.
2) The petitioners in all these writ petitions are employees of Singareni Collieries Company Limited and the grievance of the petitioners is that their dates of birth were incorrectly entered in the service records and based on the incorrect entries, without appreciating the documentary evidence. the respondents are trying to retire the petitioners prematurely. As per the company employment cards, the petitioners are entitled to continue in service till they attain the age of superannuation.
3) Learned counsel for the petitioners contended that as per the regulations there is age determination committee with the respondents and the petitioners are requesting the respondents to refer their cases to the age determination committee to ascertain the correct age of the petitioners. He further contends that appropriate orders be passed with a direction to the respondents to refer the cases of the petitioners to the age determination committee and upon such reference, the age determination committee will adjudicate the cases of the petitioners in
accordance with law based on the material produced by the petitioners.
4) The learned Standing Counsel appearing for the respondents contended that the cases of the petitioners would be considered and the petitioners would be referred to the age determination committee for ascertaining the correct age of the petitioners.
5) Having considered the rival submissions, all these writ petitions are disposed of directing the respondents to refer the cases of the petitioners to the age determination committee for ascertaining the correct age of the petitioners. It is needless to say that the age determination committee shall give an opportunity to the petitioners to put forth their cases.
6) As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. __________________________ ABHINAND KUMAR SHAVILI, J 03.04.2019 gkv
