HON'BLE SRI JUSTICE A.RAJASHEKER REDDY Tr.C.M.P.No. 17 of 2016 ORDER:

This petition is filed by the petitioner/wife to withdraw O.P.No. 1848 of 2015 from the file of Family Court, Ranga Reddy at L.B.Nagar and transfer the same to the Court of Principal Senior Civil Judge's Court/Family Court, Kakinada, East Godavari District.

The case of the petitioner is that the marriage of the petitioner was performed with the respondent on 12-11-2011 as per Hindu customs and rites. The marriage was consummated and on the day of nuptials alone, the respondent doubted chastity of petitioner and harassed her mentally and physically and abused in filthy language. Later the petitioner was driven out from home. Having no other go, the petitioner joined her parents. It is stated that the petitioner is non-working woman and entirely dependant on her parents and her father is suffering from ill-health and she has threat from the respondent. It is also stated that it is difficult for the petitioner to travel all the way from Kakinada to Ranga Reddy to defend OP filed by the respondent. As such, the present Transfer CMP is filed.

Heard learned counsel for the petitioner, who states that there is Family Court at Kakinada and OP may be transferred to it. Though notice is served on the respondent, there is no counter and there is no appearance for the respondent. The facts stated above in support of the Transfer CMP goes to show that the petitioner is living at her parents place and it is difficult for her to travel from Kakinada to Ranga Reddy to defend the OP and there is threat from the respondent.

In view of the facts and circumstances stated above are uncontroverted, O.P.No. 1848 of 2015 is withdrawn from the file of Family Court, Ranga Reddy at L.B.Nagar and transferred the same to the Family Court, Kakinada. Accordingly, Transfer CMP is disposed of.

As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 08-02-2016 nvl
