HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.7088 of 2019 ORDER:

This writ petition is filed seeking the following relief :- " .....to issue order, writ or direction more in the nature of writ of mandamus directing the respondents to consider the plea of the petitioner by restoring her name as per MERIT List for the post of Junior Panchayat Secretary....." .

Heard Mr.R.Mangulal learned counsel for petitioner and the learned Special Government Pleader for Services-II. It has been contended by the petitioner that she has applied for the post of Junior Panchayat Secretary pursuant to the Notification issued by the respondents and she has participated in the selection process and she has secured 73.75% marks in the said selection. Though she is a female candidate but wrongly at the time of uploading application form, due to technical reasons, it was uploaded as male candidate. The petitioner is a member belonging to scheduled caste community. She stood 1st among the scheduled caste candidates in Adilabad District, but the respondents are not considering her case on the ground that the gender of the petitioner was incorrectly shown in the application form.

Therefore, she submitted representations to the respondents on 22.12.2018 and 09.01.2019 requesting to permit her to change the gender from 'male' to 'female' and consider her case for appointment to the post of Junior Panchayat Secretary.

Learned Government Pleader appearing for respondents has contended that the case of the petitioner will be considered and appropriate orders would be passed in accordance with law on the representations submitted by the petitioner.

This Court, having considered the rival submissions, is of the considered view that the writ petition can be disposed of directing the respondents to consider the case of the petitioner for appointment to the post of Junior Panchayat Secretary and pass appropriate orders in accordance with law on the representations submitted by the petitioner on 22.12.2018 and 09.01.2019, within a period of six weeks from the date of receipt of a copy of this order. With the above observations, the writ petition is disposed of. No order as to costs.
