O R D E R

This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused in FIR No.84 of 2026 of Adibatla Police Station, Rachakonda Commissionerate, registered for the offence punishable under Section 69 of the BNS. 2.

The case of the prosecution is that, on 03.02.2026, the defacto complainant lodged a report before the police stating that her

- 2 - grandmother resides at Block No. 105/08 of the same colony. About four months prior, she came into contact with the petitioner herein and both of them developed a love relationship. She further stated that in November 2025, during the absence of her grandmother, while she was alone at her grandmother's house, the petitioner herein came there, professed his love, promised to marry her, and on that false promise, he physically exploited her. Later, in December 2025, the petitioner herein took her to his friend's house and again forcibly physically exploited her against her will. She stated that the petitioner herein sexually assaulted her on three occasions. She further stated that on 07.01.2026, the petitioner again came to her house, promised to marry her after settling in life, and had sexual intercourse with her. On 15.01.

2026, she suffered from fever and visited SL Clinic, where the doctor declared that she was pregnant. She immediately informed the petitioner herein over the phone, who in turn informed his family members. She further stated that on 21.01.2026, the mother of the petitioner contacted her over phone and asked her to call elders for discussion.

She further stated that on 22.01.2026, the petitioner's mother again called her and alleged that the complainant cheated her son by suppressing her age, since the complainant is 21 years old and the petitioner is 19 years old. Hence, the complainant requested to take necessary action. Basing on the said complaint, the police registered a case for the above said offence. 3.

Heard Sri V. Vijay Shankar, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the said allegation and there is no such inducement made by the petitioner herein and on the date of incident, the petitioner was 19 years old and the de-facto complainant was 21 years old. It is further submitted that the material part of the investigation was already completed and the petitioner is intermediate student and he is having exams from tomorrow. Therefore, he prayed the Court to grant bail to him by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegation against the petitioner herein is

- 4 - grievous and heinous in nature. Further, the investigation is not yet completed. At this stage; the petitioner is not entitled for the bail and prayed the Court to dismiss the criminal petition. 6.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner herein is in jail since 04.02.2026. Considering the facts and circumstances of the case, the nature of the allegation, the stage of investigation, the duration of incarceration and also the intermediate exams of the petitioner, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned XV Additional Judicial Magistrate of First Class, Ranga Reddy District, at Ibrahimpatnam.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is

- 5 - earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
