HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 28411 of 2017 Order:

Heard learned counsel for the petitioner and learned Standing Counsel for the respondents 2 to 5.

It is the case of the petitioner that the petitioner is running an educational centre for imparting education to the employees and needy people through distance mode of education. Its centres are located in Markapur and Tripuranthakam of Prakasam district. The petitioner states that the permission was obtained from the second respondent for conducting examinations to their students. Now the petitioner states that the respondents 2 to 5 are going to conduct examinations from 28.08.2017 and no information is received by the petitioner with regard to examination schedule or Hall Tickets. It is also stated that if the centre of examination is changed, the students would suffer. The petitioner also states that the last date for receipt of examination fee was closed hurriedly without giving enough time.

The above averments clearly show that the students who were imparted education by the petitioner did not remit the examination fee and in those circumstances only the respondents 2 to 5 did not intimate the examination schedule. If any student remitted the examination fee and did not receive the intimation, it is for the concerned student to ventilate his grievance. The petitioner cannot generalise the issue and approach this Court for not receiving the examination fee and raising a plea relating to the change of centre without any material. The documents filed by the petitioner relate to previous years, but there is no document accepting the petitioner as a centre for conducting

examinations by the respondents 2 to 5 for the present academic year. In the circumstances, this Court sees no ground to entertain the present Writ Petition.

The Writ Petition is, accordingly, dismissed at the admission stage. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
