THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40050 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of respondents 3 & 4 in calling the petitioner to the police station, without any crime registered against the petitioner, as illegal and arbitrary and to consequently direct respondents 3 & 4 not to call the petitioner to the police station or insist for his presence.
Heard and perused the material available on record. The case of the petitioner is that the petitioner is a senior citizen aged about 64 years and aliening from health problems. The grievance of the petitioner is that respondents 3 & 4 are calling the petitioner to the police station on every day at hard hours and making the petitioner sit for hours together without there being any crime registered against the petitioner and not taking any action on the complaint given by the petitioner against respondents 5 to 9.
Learned Assistant Government Pleader for Home, on instructions, informed this Court that two cases are registered against the petitioner in the year 2014-15 and that respondents 3 & 4 are not calling the petitioner to the police station, except for the purpose of investigation on the basis of the two cases registered against the petitioner.
Considering the grievance of the petitioner and the rival submissions, respondents 3 & 4 are directed not to call the petitioner to the police station, except for the purpose of
investigation in the two cases registered against the petitioner in the year 2014-15.
Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 6th December, 2016 KL
