HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.7097 of 2019 ORDER:

This writ petition is disposed of at the stage of admission with the consent of both the parties.

This writ petition is filed seeking the following relief :- " ..... to issue a Writ of Mandamus or any other appropriate writ, order or direction, directing the Respondents to supply the copy of Service Register of the late wife of the Petitioner namely SMT.NALLI RAJAKUMARI, Assistant Sub Inspector, Police Communications, O/ o the Respondents so as to submit the claim papers of Family Pension and other Terminal Benefit ....." .

Heard Mr.M.Venkanna, learned counsel for petitioner and the learned Special Government Pleader for Home.

It has been contended by the petitioner that his wife, who was employed with the respondents as Sub-Inspector of Police, expired on 03.09.2017. He submits that his wife has no issues and he is the only legal heir of the deceased and he is entitled for pensionary benefits. But, the respondents are not furnishing any details of the deceased employee, so as to enable the petitioner to apply for pension. To that effect, the petitioner has submitted a representation to the respondents on 19.01.2018 to furnish copy of service register of the deceased employee. But, so far, the respondents have not furnished copy of service register. Learned counsel for petitioner has contended that appropriate orders be passed in the writ petition directing the respondents to furnish copy of service register of the deceased employee, so as to enable the petitioner to apply for pension.

Learned Government Pleader appearing for respondents has contended that the case of the petitioner would be considered and appropriate order would be passed on the representation submitted by the petitioner.

This Court, having considered the rival submissions, is of the considered view that the writ petition can be disposed of directing the respondents to furnish copy of service register of the deceased employee to the petitioner by considering the representation submitted by him on 19.01.2018 and pass appropriate orders in accordance with the Rules, within a period of four weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
