HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3357 OF 2013 ORDER:

In this petition filed under Section 482 Cr.P.C, petitioner/A3 seeks to quash the proceedings in Crime No.156 of 2012 on the file of Prathipadu Police Station, East Godavari District, registered for the offences under Sections 447, 379 r/w 34 IPC.

When the matter came up for hearing, learned Assistant Public Prosecutor produced the letter dated 11.07.2018 of Assistant Sub-Inspector of Police, Prathipadu Police Station, East Godavari District and submitted that after completion of investigation, the crime was referred as 'MISTAKE OF FACT', through proceedings of the Sub Divisional Police Officer, Peddapuram, vide C.No.159/RC/ SDPO-PDP/13, dated 29.04.2013 and the final report was filed before the Judicial First Class Magistrate, Prathipadu and therefore, the subject matter of the petition which is filed to quash the proceedings in Crime No.156 of 2012 has become infructuous and hence the same may be dismissed. 3.

In view of the above submission of learned Public Prosecutor, the Criminal Petition is dismissed as Infructuous. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
