THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.7577 of 2009 ORDER:

The present Writ Petition came to be filed seeking to quash the order dated 23.12.2008 passed by the second respondent and declare the same as illegal and arbitrary.

On 09.04.2009, this Court, while issuing rule nisi, directed the respondents to allow the petitioners to use garage in question, which is in his occupation, pending further orders.

Learned counsel for the petitioner submits that the impugned order, passed by the second respondent, relates to vacating a garage which was alleged to have been using unauthorisedly. It is now submitted that the said premises has been vacated and as such no cause for adjudication survives in the petition. He further submits that W.P.No.16705 of 2009 covering the same subject matter was also dismissed as infructuous. Recording the said submission, the Writ Petition is dismissed as infructuous. No costs.

As a sequel thereto, Miscellaneous Petitions, if any, pending, shall stand dismissed.
